On October 27, 2008, a federal jury convicted Senator Ted Stevens (R-AK) on all 7 felony counts of knowingly and willfully failing to report more than $250,000 in gifts and home renovations on his Senate financial disclosure forms. Eight days later, Stevens narrowly lost his re-election to Anchorage Mayor Mark Begich.
On April 7, 2009, following a Justice Department investigation that found systematic prosecutorial misconduct — including intentional withholding of exculpatory Brady material — U.S. Attorney General Eric Holder filed a motion to vacate the conviction and dismiss the indictment. U.S. District Judge Emmet Sullivan formally granted the motion, stating 'There was never a judgment of conviction in this case. The jury's verdict is being set aside and has no legal effect.' Judge Sullivan described it as 'the worst case of prosecutorial misconduct' he had seen in more than two decades on the bench, and initiated a criminal contempt investigation into six DOJ prosecutors.
