In August 2020, Bannon was arrested on federal charges of conspiracy to commit wire fraud and money laundering in connection with the 'We Build the Wall' crowdfunding campaign. Prosecutors charged that Bannon and his co-defendants defrauded donors out of hundreds of thousands of dollars. On January 20, 2021 — his final day in office — President Trump pardoned Bannon before trial. The pardon did not extend to his three co-defendants.
In November 2021, a separate federal grand jury indicted Bannon on two counts of contempt of Congress for refusing to comply with a subpoena from the January 6 Select Committee. In July 2022, a federal jury convicted Bannon on both counts. In October 2022, U.S. District Judge Carl Nichols sentenced him to 4 months in federal prison and a $6,500 fine. After exhausting appeals, Bannon reported to prison in July 2024 and served his full 4-month sentence, being released in late October 2024.
On April 6, 2026, the Supreme Court ruled in Bannon's favor in a procedural challenge that is likely to lead to the dismissal of his contempt of Congress conviction. The ruling does not reverse the fact of his prior conviction and prison sentence.
