On February 9, 2010, the New York State Senate voted 53-8 to expel Monserrate — the first expulsion in the state Senate's history. The expulsion followed his December 2009 misdemeanor conviction for third-degree assault related to an incident in which he dragged his girlfriend through the lobby of his apartment building. He was sentenced to three years' probation, 250 hours of community service, a $1,000 fine, and a year of domestic-abuse counseling.

In May 2012, Monserrate pleaded guilty in Manhattan federal court to mail fraud for misappropriating approximately $100,000 in New York City Council discretionary funds that he directed to a non-profit organization he controlled to fund his 2006 State Senate campaign. On December 11, 2012, U.S. District Judge Colleen McMahon sentenced him to 2 years in federal prison.
